ARTICLE 1 - SCOPE OF APPLICATION

These General Terms and Conditions of Sale ("GTCS") apply, without restriction or reservation, to all sales concluded by the Seller with non-professional buyers ("the Customer") wishing to purchase the products offered for sale ("the Products") by the Seller on the locmobilhome.com website. The Products offered for sale on the website are as follows:

• Mobile homes for rent from private individuals.
• A range of concierge services to ensure your holidays run smoothly.

The main characteristics of the Products and in particular the specifications, illustrations and indications of dimensions or capacity of the Products, are presented on the locmobilhome.com website, which the customer is obliged to take note of before ordering.
The choice and purchase of a Product are the sole responsibility of the Customer.
Product offers are subject to availability, as specified when the order is placed.

These terms and conditions are available at all times on the Locmobilhome.com website and will prevail over any other document.
The Customer declares that he/she has read and accepted these terms and conditions of sale by ticking the appropriate box before placing an order on the Locmobilhome.com website.
In the absence of proof to the contrary, the data recorded in the Vendor's computer system constitutes proof of all transactions concluded with the Customer.

ARTICLE 2 - PRICES

The Products are supplied at the current prices shown on the locmobilhome.com website when the order is placed by the Seller.
Prices are given in Euros and include VAT.
Prices take into account any discounts offered by the Seller on the Locmobilhome.com website.
These prices are firm and non-revisable during their period of validity, but the Seller reserves the right, outside their period of validity, to modify the prices at any time.

Prices do not include processing, dispatch, transport and delivery charges, which are invoiced in addition, under the conditions indicated on the site and calculated before the order is placed.
The payment requested from the Customer corresponds to the total amount of the purchase, including these costs.
An invoice is drawn up by the Vendor and given to the Customer upon delivery of the Products ordered.

ARTICLE 3 - ORDERS

It is the Customer's responsibility to select the Products they wish to order on the Locmobilhome.com website, according to the following procedures:
All contracting parties must be at least 18 years old and have the legal capacity to enter into a contract and not be under guardianship or curatorship.
Bookings are made on a strictly personal basis. Under no circumstances may it be sublet or transferred.
The reservation will only be valid after agreement between the owner of the mobile home booked and Loc Mobil-home.

Product offers are valid for as long as they are visible on the site, while stocks last.
The sale will not be considered valid until the price has been paid in full. It is the Customer's responsibility to check the accuracy of the order and to report any errors immediately.
Any order placed on the Locmobilhome.com website constitutes the formation of a distance contract between the Customer and the Seller.
The Vendor reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order.
Customers can track the progress of their order on the site.

Any cancellation of the order by the Customer after its acceptance by the Seller will only be possible under the cancellation conditions specific to each advertisement and specified on each of them.

ARTICLE 3 BIS - CUSTOMER AREA - ACCOUNT

In order to place an order, the Customer is invited to create an account (personal space).
To do this, they must register by filling in the form provided at the time of ordering and undertake to provide truthful and accurate information about their civil status and contact details, in particular their email address.
The Customer is responsible for updating the information provided. Customers are advised that they can change this information by logging into their account.

To access their personal space and order history, Customers must identify themselves using their user name and password, which will be sent to them after registration and which are strictly personal. In this respect, the Customer agrees not to divulge them in any way. Should this not be the case, the Customer shall remain solely responsible for any use made thereof.
Customers may also request to unsubscribe by visiting the dedicated page in their personal space or by sending an email to: contact@locmobilhome.com. This will take effect within a reasonable period of time.

In case of non-compliance with the general conditions of sale and / or use, the site Locmobilhome.com may suspend or close the account of a customer after formal notice sent by email and remained without effect.
Any deletion of an account, for whatever reason, entails the pure and simple deletion of all the Customer's personal information.
The Seller shall not be held liable for any event due to force majeure resulting in malfunction of the site or server, subject to any interruption or modification in the event of maintenance.
The creation of an account implies acceptance of these general terms and conditions of sale.

ARTICLE 4 - TERMS OF PAYMENT

The price is paid by secure payment as follows: payment by bank card

The price is payable in full by the Customer on the day the order is placed.
However, where this option is indicated on the locmobilhome.com website, the Customer may pay in accordance with the following conditions and payment schedule:
30 % on booking and the balance 30 days before arrival at the campsite.

In this case, in the event of late payment and payment of the sums due by the Customer beyond the deadlines set out above, and after the payment date shown on the invoice sent to the Customer, late payment penalties calculated at the legal rate applicable to the amount including tax of the purchase price shown on the said invoice (may not be less than 15.21 % (3 x the legal interest rate of 1^er quarter 2024Late payment will result in the immediate payment of all sums owed by the Customer, without prejudice to any other action that the Seller may be entitled to take against the Customer in this respect.
In addition, the Seller reserves the right, in the event of non-compliance with the payment conditions set out above, to suspend or cancel the delivery of orders in progress placed by the Customer.

Payment data is exchanged in encrypted mode using the protocol defined by the approved payment service provider for banking transactions carried out on the locmobilhome.com website.
Payments made by the Customer will not be considered final until the Seller has actually received the sums due.
The Vendor shall not be obliged to deliver the Products ordered by the Customer if the Customer does not pay the Vendor the price in full in accordance with the conditions set out above.

ARTICLE 5 - CANCELLATION CONDITIONS

Cancellation conditions are specific to each advert and are specified on each advert.

ARTICLE 6 - RIGHT OF WITHDRAWAL

In accordance with article L221-18 and article L221-28, the 7-day right of withdrawal does not apply in the case of an accommodation service provided on a specific date or at a specific time.
The contract is therefore definitively concluded as soon as the Customer places the order in accordance with the terms and conditions specified in these GTCS.

ARTICLE 7 - SELLER'S LIABILITY - GUARANTEES

The Products supplied by the Seller benefit from :

• the legal guarantee of conformity, for defective, damaged Products or Products that do not correspond to the order,
• the legal warranty against hidden defects resulting from a material, design or manufacturing defect affecting the products delivered and rendering them unfit for use,

Provisions relating to legal guarantees
Article L217-4 of the Consumer Code
"The seller is obliged to deliver goods in conformity with the contract and is liable for any lack of conformity at the time of delivery.
Article L217-5 of the Consumer Code
"The property conforms to the contract:
1° Whether it is fit for the use ordinarily expected of similar goods and, if so :
- if it corresponds to the description given by the seller and has the qualities that the seller presented to the buyer in the form of a sample or model;
- it has the qualities that a purchaser may legitimately expect, having regard to the public statements made by the seller, the producer or his representative, particularly in advertising or labelling
2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the seller's attention and accepted by the latter.

Article 1641 of the French Civil Code.
"The seller is liable for any hidden defects in the goods sold that render them unfit for their intended use, or that impair that use to such an extent that the buyer would not have purchased them, or would have paid a lower price for them, had he or she been aware of them.

ARTICLE 8 - PERSONAL DATA

The Customer is hereby informed that the collection of his/her personal data is necessary for the sale of the Products and their issue/delivery, entrusted to the Seller. This personal data is collected solely for the performance of the sales contract.
Customers are also informed that the collection of their personal data is also necessary for the following purposes:
Loc mobil-home is expressly authorised to enter the information contained in the contract on a computer file.

8.1 Collection of personal data
The following personal data are collected on the Locmobilhome.com website:

Opening an account
When creating a customer/user account :
Full name, postal address, telephone number and e-mail address.

Payment
When paying for Products offered on the Locmobilhome.com website, the website records financial data relating to the Customer's bank account or credit card.

8.2 Recipients of personal data
Personal data is reserved for the sole use of the Seller and its employees.

8.3 Data controller
The data controller is the Seller, within the meaning of the French Data Protection Act and from 25 May 2018 of Regulation 2016/679 on the protection of personal data.

8.4 limitation of processing
Unless the Customer expressly agrees, his or her personal data will not be used for advertising or marketing purposes.

8.5 Data retention period
The Seller will keep the data thus collected for a period of 5 years, covering the period of prescription of the applicable contractual civil liability.

8.6 Security and confidentiality
The Seller implements organisational, technical, software and physical digital security measures to protect personal data against alteration, destruction and unauthorised access. However, it should be noted that the Internet is not a completely secure environment and the Seller cannot guarantee the security of the transmission or storage of information on the Internet.

8.7 Implementation of Customer and user rights
Pursuant to the regulations applicable to personal data, Customers and users of the Locmobilhome.com website have the following rights:
They can update or delete their data in the following ways:
In accordance with the law of 6 January 1978, the customer has a right of access and rectification to be formulated to Loc mobil-home.
The terms of implementation will be determined by mutual agreement.
They may delete their account by writing to the e-mail address indicated in article 9.3 "Data controller".
They may exercise their right of access to the personal data concerning them by writing to the address indicated in article 9.3 "Data controller".
If the personal data held by the Seller is inaccurate, they may request that the information be updated by writing to the address indicated in article 9.3 "Data controller".
They may request the deletion of their personal data, in accordance with applicable data protection laws, by writing to the address indicated in article 9.3 "Data controller".
They may also request the portability of data held by the Seller to another service provider.
Finally, they may object to the processing of their data by the Seller
These rights, provided they do not conflict with the purpose of the processing, may be exercised by sending a request by post or e-mail to the Data Controller whose contact details are given above.
The data controller must respond within a maximum of one month.
If the Customer's request is refused, reasons must be given.
The Customer is informed that in the event of refusal, he/she may lodge a complaint with the CNIL (3 place de Fontenoy, 75007 PARIS) or refer the matter to a judicial authority.
The Customer may be asked to tick a box by which they agree to receive informative and advertising e-mails from the Vendor. They may withdraw their consent at any time by contacting the Vendor (contact details above) or by following the unsubscribe link.

ARTICLE 9 - INTELLECTUAL PROPERTY

The content of the Locmobilhome.com website is the property of the Seller and its partners and is protected by French and international intellectual property laws.

Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement of copyright.

ARTICLE 10 - CONFORMITY OF ADVERTISEMENTS

The photographs published by the owners of the mobile homes are under their full responsibility with regard to their publication on the locmobilhome.com website.

The accommodation is equipped for tourist stays and may not correspond exactly to the illustrations.

Under no circumstances can locmobihome.com be held responsible for the photographs published by the advertisers (owners).

ARTICLE 11 - APPLICABLE LAW - LANGUAGE

These General Terms and Conditions and any transactions arising from them are governed by and subject to French law.

These GTC are written in French. In the event that they are translated into one or more foreign languages, only the French text will be deemed authentic in the event of a dispute.

ARTICLE 12 - DISPUTES

For any complaint, please contact the customer service department at the Seller's postal or e-mail address indicated in ARTICLE 1 of these GTCS.

The Customer is hereby informed that, in the event of a dispute, he/she may in any event have recourse to conventional mediation, with the existing sectoral mediation bodies, or to any alternative dispute resolution method (conciliation, for example).

All disputes arising from the purchase and sale transactions concluded in application of these GTCS and which have not been settled amicably between the seller or by mediation, will be submitted to the competent courts under the conditions of common law.
